Terms of Service

Welcome to True Restoration Ltd. These Terms of Service (“Agreement”) constitute a legally binding agreement between True Restoration Ltd. (“Contractor,” “we,” “us”) and the property owner or authorized agent (“Client,” “you”) regarding restoration and construction services provided at your property.

By signing a Work Authorization form or allowing us to commence work on your property, you agree to be bound by these terms.

1. Authorization and Access

You hereby authorize True Restoration Ltd. to enter the property identified by you to perform necessary cleaning, restoration, remediation, and construction services. You agree to provide a safe working environment, including access to water and electricity necessary to perform the work, at no cost to us.

2. Estimates and Unforeseen Conditions

Property restoration often involves hidden damages (e.g., water behind walls, mold under flooring) that cannot be seen during an initial inspection.

  • Estimates: Any price provided upfront is an estimate based on visible conditions. It is not a fixed-price contract unless explicitly stated.
  • Supplemental Estimates: If we discover additional damage or hazardous materials (such as asbestos or severe mold) during the course of work, we will cease work in that area and provide a supplemental estimate for the additional repairs required.

3. Insurance Processing

We work closely with insurance providers to facilitate claims. However, you acknowledge that:

  1. Policy Limits: You are responsible for knowing your insurance policy limits and coverage.
  2. Deductibles: You are responsible for paying your insurance deductible directly to True Restoration Ltd. before work is completed.
  3. Denied Claims: If your insurance carrier denies any part of the claim or refuses to pay for specific services performed, you remain personally liable for the full payment of those services.

4. Payment Terms

Unless otherwise agreed in writing:

  • Emergency Services: Payment for emergency mitigation (water extraction, board-ups) is due upon completion of the emergency phase.
  • Reconstruction: Progress payments may be required based on project milestones.
  • Overdue Accounts: Invoices not paid within 30 days of the invoice date will accrue interest at a rate of 1.5% per month (18% per annum).

Note on Liens: In accordance with provincial Construction Lien Acts, True Restoration Ltd. reserves the right to register a lien against your property for any unpaid labor or materials provided to improve the property.

5. Workmanship and Warranty

We stand behind our work. True Restoration Ltd. provides a limited warranty on workmanship for a period of one (1) year from the date of completion.

This warranty does not cover:

  • Damages caused by subsequent events (e.g., a new flood or fire).
  • Normal wear and tear.
  • Materials covered by a separate manufacturer’s warranty.
  • Pre-existing structural issues or damages not related to our scope of work.

6. Personal Property

While we take reasonable care in handling your contents (furniture, electronics, etc.), True Restoration Ltd. is not responsible for damage to items that were already damaged by the disaster event (fire, water, smoke) prior to our arrival. We recommend removing valuable or fragile items from the work area before we begin.

7. Hazardous Materials

If hazardous materials (including but not limited to asbestos, lead, or biological hazards) are discovered, we are legally required to stop work and follow specific abatement protocols. This may require hiring specialized environmental contractors, which will be billed as an additional cost.

8. Termination

You may terminate this agreement at any time by providing written notice. Upon termination, you are liable for all labor performed and materials ordered or installed up to the date of termination, plus a cancellation fee of 10% of the remaining contract value to cover administrative costs.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Province in which the property is located and the federal laws of Canada applicable therein.
